Heyward-Bey's attorney: Law wasn't followed in DUI arrest

There was an item of note today in the DUI case surrounding Raiders wideout Darrius Heyward-Bey, who was arrested on April 7 and arraigned on May 31.

Heyward-Bey's lawyer believes that there may have been procedural issues related to the DUI stop, and he is hoping to use those mistakes to get his client off the hook.

After investigating all the procedures and all the chain of events it appears not everything was done according to the rule of law, and there may be some questions that need to go before a jury, DHB's attorney, Ivan Golde, told Bay City News Service.

As Mike Florio of Pro Football Talk pointed out, "Thats a common approach in DUI cases. With a laundry list of technical requirements, lawyers for persons accused of drunk driving have plenty of potential questions to raise. It doesnt mean the defendant wasnt driving drunk. It means that the defendant may get away with doing so, thanks to mistakes made by the arresting officer."

Heyward-Bey's blood-alcohol content was measured at 0.12 percent and 0.13 percent after he was pulled over on April 7. The legal limit is 0.08 percent.
